CLARITY Act Markup Set for Jan 15; Bill to Preempt State Crypto Oversight

The Senate Banking Committee has scheduled a markup session for the Digital Asset Market Clarity Act (H.R. 3633) on January 15, setting the stage for a federal override of state-level crypto regulations. According to a report by CryptoSlate, the legislation, often referred to as the CLARITY Act, contains provisions that classify digital commodities as “covered securities,” a legal designation that explicitly preempts state jurisdiction.

The Federal Preemption Mechanism

While the industry has focused on the bill’s resolution of the SEC vs. CFTC turf war, the preemption clause represents a more immediate structural shift. By treating digital assets as covered securities, the Act would nullify the ability of state regulators to impose registration requirements or enforcement actions independent of federal standards. This effectively dismantles the “patchwork” compliance burden cited by exchanges like Coinbase and Kraken, but simultaneously removes the local oversight layer that state attorneys general have used to pursue fraud cases.

Market participants are pricing in a high likelihood of passage. Prediction markets on Kalshi currently assign a 69% probability to the bill becoming law before May 2026. This optimism aligns with the renewed institutional push for a unified rulebook, as fragmentated state oversight is viewed as the primary bottleneck for bank-grade custody solutions.
